Responding to a Takedown Notice
What Happens When You Receive a Notice
- 1We will immediately remove the allegedly infringing content
- 2You will receive notification with the takedown details
- 3The notice counts as one strike against your account
- 4You may file a counter-notice if you believe it's an error
⚠️ Three-Strike Policy for Creators
First Strike
Warning & Content Removal
Second Strike
Account Suspension (30 days)
Third Strike
Permanent Termination
Note: Strikes reset after 12 months of clean activity. Severe or willful infringement may result in immediate termination.
Filing a Counter-Notice
When to File a Counter-Notice
You may file a counter-notice if you believe the takedown was mistaken or misidentification. Valid reasons include:
- You own the copyright to the content
- You have proper licensing/authorization
- The use qualifies as fair use
- The notice contains factual errors
⚠️ Legal Warning
Filing a counter-notice initiates a legal process. The original claimant has 10-14 business days to file a lawsuit against you. If they do not, we may restore your content.
- You consent to jurisdiction in federal court
- You accept service of process from the claimant
- False counter-notices may result in legal liability
Repeat Infringer Policy
Our strict enforcement policy to protect intellectual property rights.
Account Termination Protocol
Automatic Termination Conditions
Three Valid DMCA Strikes
Upon receiving three valid DMCA takedown notices, the creator's account will be permanently terminated with no possibility of appeal.
Immediate Termination
For severe or willful infringement (mass uploading of copyrighted content, commercial piracy operations), we reserve the right to terminate accounts immediately without the three-strike process.
Pattern of Infringement
Accounts showing a pattern of infringement (multiple notices within a short period, systematic copyright violation) may be terminated at our discretion.
What Gets Terminated
- All access to the Indrajala platform
- All uploaded content (permanently deleted)
- Earnings and pending payments (forfeited)
- Email address banned from future registration
Prevention Tips for Creators
- Only upload content you created yourself
- Obtain proper licenses for any third-party material
- Keep records of content creation dates
- Respond promptly to any takedown notices
Fair Use Guidelines
Understanding copyright exceptions and educational use.
What Qualifies as Fair Use?
Likely Fair Use
- Criticism and commentary with attribution
- Parody and satire (transformative use)
- News reporting and educational content
- Small portions for analysis or review
Not Fair Use
- Reposting full movies or songs
- Using content as background/b-roll
- Monetizing others' work without permission
- Replacing the need for the original
⚠️ Fair Use is a Defense, Not a Right
Fair use is determined on a case-by-case basis in court. If you receive a DMCA notice for content you believe qualifies as fair use, you must file a counter-notice and be prepared to defend your position in court if necessary.
